1. Introduction

Welcome to Gather & Group ("we", "our", "us"). These Terms of Service ("Terms") govern your use of our website at gatherandgroup.co.uk and our wedding photo sharing and organisation service (collectively, the "Service").

By creating an account or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

These Terms should be read alongside our Privacy Policy and Cookie Policy.

2. Definitions

"Couple" or "Account Holder": The person or persons who register for an account and purchase a plan
"Guest": Any person who uploads photos or videos to a gallery using the gallery's unique upload link or QR code
"Gallery": The private collection of photos and videos associated with an account
"Content": Any photos, videos, or other media uploaded to the Service
"Plan": The subscription tier purchased (Basic or Premium)

3. Account Registration

3.1 Eligibility

You must be at least 18 years old to create an account. By registering, you confirm that you are 18 or older and have the legal capacity to enter into these Terms.

3.2 Account Information

You agree to provide accurate, current, and complete information during registration and to keep this information updated. You are responsible for maintaining the confidentiality of your account credentials.

3.3 Account Security

You are responsible for all activity that occurs under your account. You must notify us immediately if you become aware of any unauthorised use of your account.

4. Service Description

Gather & Group provides a platform for couples to collect and organise photos uploaded by their wedding guests. The Service includes:

A unique gallery with shareable upload link and QR code
Guest photo and video uploads
Photo gallery viewing and management
Image quality assessment
Download functionality
Premium features: Face grouping to organise photos by person

5. Plans & Pricing

5.1 Available Plans

We offer the following plans:

Basic: Unlimited guest uploads, 3 months storage duration, Unlimited file size limit, smart quality filter, Single zip download all photos, gdpr compliant, printed photobook creator
Premium: All Basic features plus 1 year storage duration, face recognition, search by person, save favourites, live slideshow, download by person, email reminders, person photobook creator, export to cloud storage

5.2 Price Changes

We reserve the right to change our prices at any time. Price changes will not affect plans already purchased.

6. Payment & Billing

6.1 Payment Processing

Payments are processed securely by Stripe. We do not store your payment card details. By making a purchase, you also agree to Stripe's Terms of Service.

6.2 One-Time Payment

Our plans are one-time purchases, not subscriptions. Payment is made upfront when you complete registration.

6.3 Access

Your gallery becomes active immediately upon successful payment. The storage retention period begins from your wedding date, not the payment date.

7. Refunds

7.1 Zero Uploads Money-Back Guarantee

We're confident your guests will share their photos, but if no guest uploads are received, you shouldn't pay for an empty gallery.

If you receive zero guest uploads within 14 days of your wedding date, we will provide a full refund.

To qualify for this guarantee:

You must request the refund by emailing [email protected] within 14 days of your wedding date
No photos or videos from anyone other than yourself (testing uploads) were uploaded to your gallery
We automatically track upload activity to verify zero-upload situations

This guarantee does not apply if:

Guests uploaded photos but you subsequently deleted them
More than 14 days have passed since your wedding date

7.2 Refund Before Service Use

If you have not shared your gallery link with anyone and no content has been uploaded, you may request a full refund within 14 days of purchase by contacting us.

7.3 Technical Issues

If you experience significant technical problems that prevent the Service from working as described and we cannot resolve them, we may offer a full or partial refund at our discretion.

7.4 Requesting a Refund

To request a refund under any of the above circumstances, email us at [email protected] with:

Your account email address
Your wedding date
Brief explanation of your situation

We aim to process all refund requests within 5 working days. Refunds are issued to the original payment method.

7.5 No Refund After Use

Except as described above, once the Service has been used (guest uploads received, photos viewed, or downloads made), we cannot offer refunds as the service has delivered its intended value.

8. User Content

8.1 Ownership

You retain all ownership rights in the content you upload. We do not claim ownership of your photos or videos.

8.2 Licence Grant

By uploading content, you grant us a limited, non-exclusive, royalty-free licence to store, process, display, and transmit your content solely for the purpose of providing the Service. This licence includes:

Creating thumbnails and web-optimised versions
Processing for quality assessment
Face grouping to organise photos by person (Premium accounts)
Displaying content within your private gallery

8.3 No Commercial Use

We will never use your content for marketing, advertising, or any commercial purpose without your explicit written permission.

9. Guest Uploads

9.1 Guest Terms

When guests upload content to your gallery, they agree to these Terms. As the account holder, you are responsible for informing your guests about how their photos will be used.

9.2 Guest Consent

By uploading, guests consent to their photos being viewed by the couple and processed as described in our Privacy Policy, including face grouping for Premium accounts.

9.3 Guest Visibility

Guests cannot view photos uploaded by other guests. Only the couple (account holder) can view all gallery content.

10. Acceptable Use

You agree not to use the Service to:

Upload illegal, harmful, threatening, abusive, defamatory, or objectionable content
Upload content that infringes on any third party's intellectual property or privacy rights
Upload content depicting minors in any inappropriate context
Upload malware, viruses, or any malicious code
Attempt to gain unauthorised access to our systems or other users' accounts
Use the Service for any purpose other than personal wedding photo organisation
Share your gallery credentials with anyone intending to abuse the Service
Circumvent any technical limitations or security measures

We reserve the right to remove content and suspend accounts that violate these terms.

11. Intellectual Property

11.1 Our Property

The Service, including its design, features, functionality, and underlying technology, is owned by Gather & Group and protected by UK and international intellectual property laws.

11.2 Your Content

You retain all intellectual property rights in your uploaded content. You represent that you have the right to upload and share all content you submit.

12. Data Storage & Expiry

12.1 Storage Period

Your content is stored for the duration specified by your plan:

Basic: 3 months from your wedding date
Premium: 12 months from your wedding date

12.2 Expiry Notifications

We will send email reminders at 30, 7, 3, and 1 day(s) before your storage expires. It is your responsibility to download your photos before the expiry date.

12.3 Grace Period

After expiry, your content is soft-deleted and retained for an additional 30 days. During this period, content is hidden but may be recoverable by contacting support.

12.4 Permanent Deletion

After the 30-day grace period, all content is permanently deleted and cannot be recovered.

Important: We strongly recommend downloading your photos well before the expiry date. We are not responsible for any content lost due to expiry.

13. Termination

13.1 By You

You may request account deletion at any time by contacting us. Deleting your account will result in the permanent deletion of all associated content.

13.2 By Us

We may suspend or terminate your account if you:

Violate these Terms
Engage in illegal activity
Upload prohibited content
Attempt to abuse or exploit the Service

13.3 Effect of Termination

Upon termination, your access to the Service will cease and your content may be deleted. Sections of these Terms that by their nature should survive will continue to apply.

14. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

Warranties of merchantability or fitness for a particular purpose
Warranties that the Service will be uninterrupted, error-free, or secure
Warranties regarding the accuracy of face grouping results
Warranties regarding the preservation or backup of your content

While we take reasonable measures to secure your data, we cannot guarantee absolute security.

15. Limitation of Liability

To the maximum extent permitted by UK law:

We are not liable for any indirect, incidental, special, consequential, or punitive damages
We are not liable for any loss of data, including photos and videos
We are not liable for any damages arising from your use or inability to use the Service
Our total liability for any claim shall not exceed the amount you paid for the Service

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by UK law.

16. Indemnification

You agree to indemnify and hold harmless Gather & Group and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use of the Service
Your violation of these Terms
Your violation of any third party's rights
Content you upload to the Service

17. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by email or by posting a notice on our website. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

18. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
